Terms of Service

These Terms of Service ("Terms") apply to your use of brkn25.com (the "Store") and to any purchase you make from us. "BRKN", "we", "us" and "our" means the business trading as BRKN, based in Adelaide, South Australia. By using the Store or placing an order, you agree to these Terms. Please read them carefully.

1. Our products

BRKN sells streetwear and accessories that are printed, embroidered or produced to order after you buy them, by our production partners. We aim to show products as accurately as possible, but colours can look different on different screens. Washed and dyed garments (such as snow-wash and vintage-wash pieces) vary slightly in tone from piece to piece; this is part of the finish and is not a fault. Measurements in our Size Guide are approximate.

2. Orders

Your order is an offer to buy. A contract is formed when we accept your order, which happens when we send your order confirmation email. We may decline or cancel an order (for example, if a product is unavailable, a pricing or description error has occurred, or we suspect fraud). If we cancel an order you have paid for, we will refund you in full.

Because production starts quickly, if you need to change or cancel an order, email us as soon as possible with your order number. Once an item is in production we can't guarantee changes or cancellation.

3. Prices and payment

All prices are in Australian dollars (AUD). Shipping costs are calculated and shown at checkout before you pay. We may change prices at any time, but a change will not affect an order we have already accepted. Payment is taken at checkout through our payment providers. International customers may be charged import duties or taxes by their country, which are the customer's responsibility.

4. Discount codes

Discount codes are subject to the conditions stated when they are offered (for example, first order only, one use per customer, or not combinable with other offers). Codes have no cash value and cannot be applied to past orders.

5. Shipping and delivery

We ship Australia-wide and to selected international destinations. Delivery options and costs are shown at checkout. Multi-item orders may arrive in separate parcels. Please make sure your delivery address is correct; we can't always redirect a parcel once it has shipped. Risk in the goods passes to you on delivery. Full details are in our Shipping Policy.

6. Returns and refunds

Every BRKN item is made to order for you. For this reason, we do not accept returns, exchanges or refunds for change of mind, including where you have ordered the wrong size. Please check the Size Guide before ordering.

We will provide a replacement or refund if an item arrives faulty or defective, damaged in transit, or incorrect (a different item, size or colour from what you ordered). Contact us by email as soon as possible after delivery with your order number, the affected item, a description of the issue and clear photos. Please don't send anything back without contacting us first. If we need the item returned, we will cover reasonable return postage. Approved refunds are made to the original payment method. 7. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

8. Use of the Store

You must not misuse the Store, including by attempting to interfere with its operation, gain unauthorised access, or use it for any unlawful purpose. You must provide accurate information when placing an order.

9. Intellectual property

The BRKN name, logos, designs, graphics, photos and text on the Store belong to BRKN or are used with permission. You may not copy, reproduce or use them for commercial purposes without our written consent.

10. Limitation of liability

Subject to section 7 and to the extent permitted by law, we are not liable for any indirect or consequential loss arising from your use of the Store or our products, and our liability for any product is limited to replacing it, or refunding the price you paid for it.

11. Privacy

We handle your personal information in accordance with our Privacy Policy.

12. Governing law

These Terms are governed by the laws of South Australia, Australia. You and we submit to the non-exclusive jurisdiction of the courts of South Australia.

13. Changes to these Terms

We may update these Terms from time to time. The version published on the Store at the time you place your order applies to that order.
